Digital evidence has transformed domestic violence litigation in India. WhatsApp messages, email chains and social media records are now routinely presented in family courts, and when properly preserved and certified, they carry significant evidentiary weight.
Step 1: Preserve immediately. Screenshots are vulnerable. Take screenshots and back them up to multiple locations immediately. Metadata — including timestamps and delivery status — is part of the evidentiary record. Do not delete anything, even messages that seem innocuous.
Step 2: Certification under Section 65B. Under Section 65B of the Indian Evidence Act, electronic records require a certificate from the person responsible for the device to be admissible in court. This certificate must confirm the device, the period of operation, and the authenticity of the records.
